1. Acceptance of Terms
By accessing or using the TeachNEW platform ("Platform," "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you may not use the Platform.
If you are using the Platform on behalf of a school division, you represent that you have the authority to bind that division to these Terms, and you agree to these Terms on the division's behalf.
2. Description of Service
TeachNEW is a Software-as-a-Service (SaaS) curriculum resource management and intelligence platform designed for Alberta K-12 school divisions. The Platform enables educators to:
- Upload, organise, and share teaching resources aligned to Alberta curriculum outcomes
- Access a division-wide community library of peer-reviewed lessons and materials
- Use AI-powered tools to suggest curriculum outcome alignments
- Link and manage Google Drive teaching resources
- Allow division leadership to view curriculum coverage reports and gap analytics
We reserve the right to modify, suspend, or discontinue any feature of the Platform at any time, with reasonable notice to active divisions.
3. Eligibility
The Platform is intended for use by:
- Classroom teachers and educators employed by or contracted to an Alberta school division
- School division administrators and instructional leaders
- TeachNEW platform operators acting on behalf of school divisions
The Platform is not intended for direct use by students. If you are a student, you are not authorised to create an account or access the Platform. Please contact your school division if you have questions.
Access to the Platform requires that your school division has an active subscription or pilot agreement with TeachNEW, and that your Google account email is associated with your division's authorised domain or allowlist.
4. Accounts and Access
Sign-in
You must sign in using a Google account authorised by your school division. TeachNEW does not maintain separate username or password credentials. By signing in, you authorise TeachNEW to receive your Google account email, display name, and profile photo as described in our Privacy Policy.
Account security
You are responsible for maintaining the security of your Google account. You must notify your division administrator and TeachNEW promptly if you become aware of any unauthorised access to your account.
Division administrators
Division administrators have elevated access within the Platform, including the ability to manage settings, promote users, and view division-wide data. Administrators are responsible for ensuring that their division's use of the Platform complies with these Terms and applicable law.
5. Acceptable Use
You agree to use the Platform only for lawful purposes and in accordance with these Terms. You must not:
Prohibited content
- Upload, share, or transmit content that is illegal, defamatory, harassing, threatening, or obscene
- Upload content that infringes the intellectual property rights of any third party without appropriate authorisation or licence
- Include personally identifiable student information (such as student names, student ID numbers, or photos of students) in lesson content, materials, or any content shared through the Platform
- Include personally identifiable information about other individuals without their consent
Prohibited technical conduct
- Attempt to gain unauthorised access to any part of the Platform, other users' accounts, or any systems or networks connected to the Platform
- Reverse engineer, decompile, or attempt to extract the source code of the Platform
- Introduce malware, viruses, or any other malicious code to the Platform
- Use automated tools to scrape, crawl, or extract data from the Platform without our express written consent
- Attempt to circumvent, disable, or interfere with any security feature of the Platform
- Share your login credentials with individuals who are not authorised users of your division
Community library conduct
- When publishing lessons to the division community library, you confirm that the content is either your original work or that you have the right to share it, as indicated by the attestation required at the time of publishing
- Lesson reviews and ratings must be honest and based on genuine professional experience with the material
TeachNEW reserves the right to remove content and suspend or terminate access for violations of this section, without prior notice where necessary to protect the Platform or other users.
6. Your Content
Ownership
You retain ownership of all curriculum content, lesson plans, resources, and materials you create and upload to the Platform ("Your Content"). TeachNEW does not claim ownership of Your Content.
Licence to TeachNEW
By uploading or submitting content to the Platform, you grant TeachNEW a limited, non-exclusive, royalty-free licence to store, display, and process Your Content solely as necessary to provide the Platform services to you and your division. We do not use your content for any purpose outside of operating the Platform.
Community sharing
If you publish content to your division's community library, you grant other authorised users within your division the right to view and use that content for educational purposes within the Platform. You represent that you have the right to share any content you publish to the community library.
Your responsibility
You are solely responsible for the content you upload and share through the Platform. TeachNEW does not pre-screen or review content before it is uploaded, but reserves the right to remove content that violates these Terms.
7. AI-Powered Features
The Platform includes AI-assisted features powered by Google's Gemini API. By using these features, you acknowledge and agree that:
- Content you submit to AI-powered features (lesson descriptions, curriculum documents) is transmitted to Google's Gemini API for processing as described in our Privacy Policy.
- AI-generated suggestions are provided for informational purposes only. You are responsible for reviewing all AI-generated content before using it in your professional practice.
- You must not submit student personal information, confidential student records, or other sensitive personal information to AI-powered features. The Platform displays reminders of this requirement at relevant points.
- AI-generated suggestions may be inaccurate, incomplete, or inappropriate for your specific context. TeachNEW makes no representations about the accuracy or fitness of AI-generated content.
8. Google Services
TeachNEW integrates with several Google services, including Google Sign-In, Google Drive, and Firebase. Your use of these integrations is also governed by Google's Terms of Service and Privacy Policy.
By connecting your Google Drive to TeachNEW, you authorise TeachNEW to access your Drive files as described in our Privacy Policy. You can revoke this access at any time through your Google Account permissions. Revoking access may limit certain Platform features.
TeachNEW's use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.
9. Intellectual Property
TeachNEW's intellectual property
The Platform, including its software, design, features, trademarks, and documentation, is owned by TeachNEW and is protected by Canadian and international intellectual property law. These Terms do not grant you any ownership rights in the Platform.
Your division's intellectual property
Curriculum content created by your division's educators remains the intellectual property of the creating educator or the school division, as determined by your division's policies and applicable employment law. TeachNEW does not claim any rights to curriculum content created by your division.
Alberta curriculum
References to Alberta Education curriculum outcomes are made for alignment and organisational purposes. Alberta curriculum documents are the intellectual property of the Government of Alberta.
10. Fees and Payment
Fees for the Platform are set out in the Master Service Agreement (MSA) between TeachNEW and your school division. If your division is in a pilot period, the Platform is provided at no cost for the duration of the pilot as specified in your Pilot Agreement.
Individual educators do not pay separately for the Platform; access is provided through your school division's subscription. Questions about billing should be directed to your division administrator or to customschoolsoftware@gmail.com.
11. Termination
Termination by you
You may stop using the Platform at any time. If you wish to delete your account and associated data, contact us at customschoolsoftware@gmail.com.
Termination by TeachNEW
We may suspend or terminate your access to the Platform if:
- You violate these Terms
- Your school division's subscription expires or is terminated
- We are required to do so by law
- We determine, in our reasonable judgment, that continued access poses a risk to the Platform or other users
Where possible, we will provide notice before terminating access. Where a violation is serious or poses an immediate risk, we may terminate access without prior notice.
Effect of termination
Upon termination of your account, your right to access the Platform ceases immediately. Content you have published to your division's community library may remain accessible to other division members unless your division administrator removes it. Your personal profile data will be deleted in accordance with our Privacy Policy.
12. Disclaimers
TeachNEW does not warrant that:
- The Platform will be available at all times or error-free
- AI-generated suggestions will be accurate, complete, or appropriate for your use
- The Platform will meet all requirements of any specific school division policy or provincial regulation
You are responsible for ensuring that your use of the Platform complies with your school division's policies and applicable Alberta and Canadian law.
13. Limitation of Liability
TeachNEW's total liability to you for any claims arising from your use of the Platform shall not exceed the greater of: (a) the total fees paid by your school division in the twelve months preceding the claim; or (b) one hundred Canadian dollars (CAD $100.00).
Some jurisdictions do not allow the exclusion or limitation of liability for certain types of damages. In such jurisdictions, TeachNEW's liability is limited to the greatest extent permitted by law.
14. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any dispute arising from these Terms or your use of the Platform shall first be subject to good-faith negotiation between you and TeachNEW. If a dispute cannot be resolved through negotiation within thirty (30) days, it may be submitted to the courts of Alberta, which shall have exclusive jurisdiction.
15. Changes to These Terms
We may update these Terms from time to time to reflect changes in the Platform, applicable law, or our practices. When we make material changes, we will:
- Update the "Last updated" date at the top of this page
- Notify active division administrators by email at least 30 days before changes take effect
Your continued use of the Platform after updated Terms take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Platform and notify your division administrator.
